Terms and Conditions

1. Acceptance of terms

By creating an account or using the Western Horsepower mobile application ("the App"), operated by Western Horsepower Ltd ("we", "us", "our"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the App.

2. Assumption of risk — horseback riding

Horseback riding is inherently dangerous. By using this app, you voluntarily assume all risks associated with working with, riding, and handling horses.

You acknowledge and agree that:

  • Horses are large, unpredictable animals. Injury, disability, or death can occur.
  • You are solely responsible for your own safety and the safety of your horse.
  • You will wear a properly fitted equestrian helmet and appropriate footwear when riding.
  • You will only attempt challenges your horse and you are physically and mentally prepared for.
  • You will not attempt any challenge in unsafe conditions (weather, footing, or horse behavior).
  • You are responsible for ensuring your tack and equipment are safe and properly fitted.
  • You should have a trainer or experienced rider present if attempting anything new or advanced.

3. AI-generated content is not professional advice

Daily challenges, riding patterns, and suggestions in the App are generated by artificial intelligence (currently Anthropic Claude). They are intended as general training ideas for experienced riders and are NOT:

  • A substitute for qualified equestrian instruction, coaching, or training.
  • Veterinary, medical, or behavioral advice for you or your horse.
  • Guaranteed to be safe, accurate, or suitable for your specific horse, discipline, or skill level.

You must exercise your own judgment before following any suggestion. If anything feels wrong, STOP and consult a qualified trainer or veterinarian.

4. Account registration

You must be at least 13 years old to use the App. Riders under 16 should use the App with a parent or guardian's knowledge. You are responsible for keeping your login credentials secure and for all activity under your account. You agree to provide accurate information and keep your profile up to date.

5. Acceptable use

You agree NOT to:

  • Share your account with other people.
  • Attempt to reverse-engineer, abuse, or overload the App or AI systems.
  • Upload content that is illegal, abusive, copyrighted by others, or depicts animal cruelty.
  • Use the App for any commercial purpose (training business, clinic, etc.) without a written license.

6. Pro subscription

Pro subscriptions are billed through Apple App Store, Google Play Store, or Stripe and renew automatically until cancelled. You can cancel anytime through your platform's subscription settings. Refunds follow the policy of the billing platform. See our Privacy Policy for data handling details.

7. Intellectual property

The App, its name, visual design, and original content are owned by Western Horsepower Ltd. You retain ownership of ride journals, horse photos, and other content you upload, and you grant us a limited license to store and display that content back to you inside the App.

8. Limitation of liability

To the maximum extent allowed by law, Western Horsepower Ltd and its officers, employees, and contractors are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the App — including injury to you, your horse, or others, property damage, data loss, or loss of profits.

Our total liability for any claim is limited to the amount you paid us in the twelve (12) months before the claim arose (or $50 USD if you are a free-tier user).

9. Indemnification

You agree to defend and indemnify Western Horsepower Ltd against any claim by a third party arising from your use of the App or your interaction with a horse, including but not limited to injury claims, trespass, or damage to property.

10. Termination

We may suspend or terminate your account at any time for breach of these Terms. You may delete your account anytime by contacting support. Deletion removes your personal data within 30 days except where we are legally required to retain records.

11. Governing law

These Terms are governed by the laws of the United Kingdom, without regard to conflict-of-law principles. Any dispute will be resolved in the courts of the United Kingdom.

12. Changes

We may update these Terms from time to time. Material changes will be announced in-app. Continued use after updates means you accept the new Terms.
